don't pass it, it is so critical today have to borrow from china. >> he is going to have a busy day. >> find out who came out the winner in the poll. >> police in one city could be on the brink of a drastic change. mornings on two begins right now. >> complete bay area news coverage starts right now, this is ktvu mornings on 2. >> good morning, welcome to mornings on 2, i am dave clark. >> i am tori campbell, thursday, october 4th. we begin with developing news on the morning commute. bart has been experiencing major system-wide delays to the past two hours. ktvu's alex savidge is live there with developments. >> reporter: good morning, yes, this was a stalled work vehicle that had triggered delays earlier on. but that problem has been taken care of. we did just get word from bart a couple of minutes ago that

all of their trains this morning are now running on time. earlier on the delays were significant. show you video of what it looks like here with video. a bart spokesman told us they were experiencing 40 minute delays on two lines from the east bay into san francisco. that would be those lines. this was because of a maintenance vehicle blocking tracks early this morning south of the mcarthur station. now that vehicle has been cleared out of the way but trains were backed up. everything started about 4:30 this morning when that vehicle that rides actually on the bart tracks itself came off the tracks and the obviously the bart trains going through that area had to slow down. the delays were frustrating for bart riders. >> i am supposed to catch an amtrak to sacramento, so if i miss that train it is an hour

and a half wait so i might not go to sacramento today. >> it goes with the territory, bart mainly is clean, safe, economical way to get to work, you just have to understand sometimes there will be mechanical error, sometimes you know even a human failure once in a while. it goes with the territory. >> bart passengers seem to by pretty understanding this morning. workers had to work throughout the early morning to clear up this problem and bring in a separate vehicle to remove the stalled work truck on the tracks and did that. still unclear this morning talking with a bart spokesperson why that vehicle got stuck in the first place or why it came off the tracks, triggering these delays but workers were called in and inspected the tracks and everything looks fine and all 60 trains are on time this morning. live at the mcarthur station,

alex savidge. >> a former marine is accused of shooting his two neighbors. claudine wong is there to tell us what led up to the shooting and the relationship between the suspect and the victims. >> reporter: dave, neighbors here painting the picture for us that doesn't make sense with what happened last night. let's take you through it. this is the driveway of the home where the shooting happened. neighbors tell us a couple lives there and was often seen in their driveway with friends. let's show you where the suspect lives. right across the street in this home. that is where 65-year-old martin lived and was out a lot with his dog, a former marine and people say he was helpful and also tell us both parties got along. something happened last night though and we are still not sure what led up to it. all we know is police said around 6:00 p.m. he walked across the street and

shot two people. those victims have not been identified, we have been given their ages as 50 and 58. one woman whose mother lived in the neighborhood was in tears. >> i missed the tears and he said do you know what happened. and i said it. i googled it and saw it and said i can't believe it, i got to go see it. >> after the shooting there was a stand off but then the spokesperson convinced him to surrender and they removed the bodies and they cleaned it all up but residents still find it all hard to believe. >> quite shocking because it is a quiet neighborhood and from these two guys, today are very good friends from what i see and the guy across the street always help around the neighborhood you know cleaning

yards, help pick up you know garbage. >> this is a picture from facebook that we got this morning of martin, again 65 years old, in the marines, served in viet nam, grew up in hayward, so a local guy and again well-known out here in this glen cove neighborhood that neighbors say is a very very quiet neighborhood. you can see as we come back out here live the marine core flag and stickers on his vehicle out in his garage, parents -- neighbors say he lived here alone and has adult children who live out of state. claudine wong, ktvu channel do news. >> 7:06. the chp is investigating a crash of an out of control truck on 880 in hayward around midnight on 880 south north of jackson street. two people were trapped in the overturned truck when emergency responders arrived. >> the vehicle for some reason veered to the right. it left the roadway and ended up overturning. >> officers say the two people

we keep our eyes on sal. >> traffic is doing well around the bay area. as a matter of fact, looking at at the bay bridge, which is normal, for this time of the morning this is not unusual to have a big back up. it has become the new normal for this traffic to be backed up for a 25 to 30 minute they but no problems on the bridge. an earlier stalled vehicle, they removed that. bart is back on time by the way according to bart after earlier delays. this is north and southbound 101. we have congestion here on southbound 101 right there at the 80 split as you can see on the right-hand-side of your screen. san jose. northbound 101 heavy traffic and 280 taking a beating downtown as people want to get into cupertino and sunnyvale and it is busy and 85 is slow through los gatos and saratoga. let's go to steve. >> we have a lot of fog.

it took the turn and did that there took a while for some but everyone started too feel a breeze late in the day but not before 90s hit. that is not the case today. it is there, the coast and much of the city notice the big drop in temperatures yesterday. that temperature drop will continue today. but for those inland, 50s 60s there, 70s inland and with 80s west wind. a very hot san francisco to now a cool two days ago, 90, yesterday 74, today 62, so again be careful what you wish for. i want it to be warmer, where is my summer there it goes with that and that and that. 50s and 60s on the temperatures when you get a west-southwest to travis almost 30 miles an hour in a westerly direction or southwest almost everywhere else yesterday at this time it was calm, calm, quiet, not the case today. building high up into the gulf of alaska is an area of high pressure. this low right there is heading towards us and that is going to

stood out last night for being aggressive, constantly calling out president obama, keeping him on the defensive side. mitt romney also didn't back down when the two butted hads over tax plans. the president says romney's plans will raise taxes or increase the deficit. >> governor romney's central economic plan calls for a 5 trillion dollar tax cut on top of the extension of bush tax cuts another trillion dollars and 2 trillion in military spending they have not asked for. >> first of all i don't have a 5 trillion dollar tax cut or a tax cut of the scale you are talking about. >> romney says he will offset cuts by closing loopholes and reducing reductions but vague on which ones. they will face off again later in new york and florida. both candidates are back on the campaign trail today. mitt romney in virginia while the president has campaign

it is 7:30, a deadly birthday party became the scene of a deadly shooting overnight. someone shot a man outside a home there when janine de la vega joins us with the latest information you have received from police. good morning. >> reporter: good morning. police are back at the station piecing this together. you could see this morning people have been grieving the loss of a 24-year-old man. now he doesn't live here. he was barbecuing outside the house when he got shot. around 10 people were at this house there celebrating a birthday party. police say today received a 911 call at 12:30. when they arrived they found a 24-year-old man shot with gunshot wound. 1 witness there describes it. >> we were outside barbecuing, all you hear is about three to four guys outside cooking barbecue, run into the house

and all you hear is saying shots, shots fired, shots fired, the guy that had got shot runs into the house, drops to the floor. >> the man died there. the witness told us others there reportedly saw gang members wearing blue running away but police say they think the only -- the victim was the one who saw the shooter. detectives are telling us it appears to be gang related but friends of the victim say he was not a gang member and nobody was wearing gang colors. no one is in custody and we do not have a description. this is san jose's 36 homicide. janine de la de la vega, channel 2 news. >> another man was killed there downtown. police say the fight happened around 8:30. he was pronounced dead before

10:00. >> police also investigating another shooting. a deputy shot a suspicious man on the cal train tracks. this happened at a maintenance facility near the station and delayed trains during the rush hour. news chopper two was flying over the scene. police say the man had been lying on the tracks and became aggressive when a deputy approached him. the deputcalled for back up when he started picking things up off the ground to use as weapons. >> he displayed a aggressive behavior that the deputy believed was a danger to his safety and that of the other deputies. >> police say the 29-year-old moon is from san jose, his injuries are not life- threatening. investigators want to know if he is mentally ill or under the influence of drugs. later today he will take

be alive. police want your help, trying to find two men suspected of robbing a bank in livermore, that happened yesterday there. the suspects described as african american men in their 20s, with short hair. one of the suspects said to be about 5'9," was last seen wearing a white t-shirt and shorts with a purple bag or bandana. the second suspect was seen wearing a black shirt with a gold imprint and blue jeans. >> it is 7:36. new this morning turkey's parliament is authorizing military sanctions against syria but says this is for this is not a declaration of war as they continue to do that. an aid says this is in response to an attack that killed 5 women. they say syria should consider it a warning. according to a new book

osama bin laden could have ended up in trial if he had surrendered. for his book in the finish the journalist interviewed the president and the president is quoted as saying he would have argued in favor of giving osama bin laden the full rights of a criminal defendant. he also would have tried osama bin laden as the mastermind of the september 11th attacks. the book is set to be released on october 16th. >> later this morning three supervisors will call for an investigation into scams that target old women. thieves are convincing victims to put their jewelry into a bag to ward off bad spirits and don't open it for jewel days and when they do the jewelry has been replaced by rocks. police say these thieves are targeting chinese woman who don't have bank accounts. critics of smart meters have declared today a national

breaking through a big fog bank. i will tell you it has lifted and continues to get there and has been howling inland. high clouds clipping us. no big deal if you are under that you can't see them. all in thing of a cooling trend and did it cool down, 30 degrees cooler. that fog came there, there and right went up there and temperatures drop. well today the inland temperatures go way down, 90s yesterday, that will not be the case yesterday or today i should say. hot to cool there. two days ago 94 degrees, yesterday 74. today going 62. under mostly cloudy skies. upper 50s, low 60s. these lows have been there all morning long. they are not going to change. we get a breeze anywhere out of the west or south or just a sea breeze in place way out even to the sacramento delta that tells you that is is cooler. very strong cold system into

stocks opening higher on wall street following an encouraging report on the labor market and better sales from retail chains, retailers reported september sales that came in ahead of estimates. a live look, the dow up 85, the nasdaq up 8, s&p up 9. the number of americans filing for first time unemployment benefits rose to 367,000 last week, up 4000 from the week before, but it is still fewer than the 370,00 economists had forecast. california's jobless number dropped by more than 13,000 after fewer layoffs in the service tech tore than the week before. tomorrow the big monthly unemployment number comes out. it is expected to go up slightly from the current 8.1% nationally. jet blue is offering a way for travelers to live up their to threats to leave the country if today preferred candidate does not win the presidential

issues and they got bogged down on issues, there were key issues not mentioned like immigration, woman's issues gay marriage. why do you think that was? >> you are right. i think that was very striking. not even mentioned was the 47% comment, mitt romney's controversial comment. i think the moderator tried to keep them in control but wasn't successful at times. you had attacks and counter attacks going on. it was a civil debate but didn't cover ground. there are two more left, both of them town hall type formats and we will see more of those issues discussed in the next two. >> what are their advisors telling them? what do they need to do to get ready for the next debate? >> republicans are pumped. this was a must win for romney,

this was a make or break moment and a lot of people felt he needed a game changer and got it. for obama this is an unusual situation, he was a gift communicator but not on the game tonight. from the looks here, maybe his supporters are doubling down and say we are going to push him on and cheer him on but he is going to have to do better in the next debates, no question about it. we may see a bump from mitt romney, so right now, this may be back to a nail-biter. these candidates are even in a lot of the swing states so from here on out it is more drama. >> yeah, and some people are saying the president seemed rusty. do you think he was overconfident, distracted, tired? it was his 20th anniversary, maybe he would have been with michelle. >> yeah, no excuses, the no drama obama didn't work for

a party. this attack happened there. janine de la vega is there and you talked to the witnesses, what did they say? >> reporter: they are shaken up. we do know there are conflicting reports. police say they know somebody opened fire on a 24-year-old man here. he didn't live at this home but he was bar-be-quing here when he got shot. 10 people were at the house there in east san jose celebrating a birthday party. police say they received a 911 call at 12:30. when they arrived they found a 24-year-old man shot with a gun shot wound to his chest. one witness, who didn't want to be identified, says the victim walked into the house after that and collapsed. >> he was shot. front, ran into the house and collapsed. he could not -- he could not talk. he was screaming and -- he -- we could not understand what he was saying. >> that victim died at the scene. the witness told us others at

each other every day. live lear in vallejo, claudine wong, ktvu channel 2 news. >> 8:48. the government is investigating claims that anti-israel protests created a hostile environment for jewish students there. the u.s. department of education launched an investigation into the charges filed in july by two graduates. the complaint says the school's all apartheid weekend couraged that. they say the protests are protected free speech. today could be the beginning of big changes for the oakland police department. pam cook is there with a case that actually started then. right? >> reporter: yes, it did. today the plaintiffs are preparing to ask the judge to place the police department under federal control. while the city fights a federal take over, a new report is not helping the case.

it finds they were understaffed and insufficiently prepared to handle the protests and says the response calls into question whether or not the department is following court mandated reforms. those reforms were ordered about 10 years ago after a police scandal phone as the riders case. a case of police brutality. now the attorneys for the victims in that case are filing a motion asking for that federal take over. a hearing is scheduled for december 13th. some of those things that will be brought up in that hearing officers response to the occupy protests and some recent police involved shootings. the head of the police union defends officers actions in the chronicle today in light of that report. he says oakland police officers see more violence in a shift than many officers in the country see in an entire year. reporting live in the newsroom, pam cook, back over to the studio.
